Terms of Service

1. Acceptance of Terms
By accessing or using Donation Retriever, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users including organization administrators, team members, and donors.
2. Description of Service
Donation Retriever is a web-based platform that helps nonprofit organizations accept, catalog, and manage in-kind (non-cash) donations. The service includes donation tracking, donor management, team collaboration, analytics, and donor-facing submission pages. It is a multi-tenant software-as-a-service application.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your login credentials and for all activity under your account. You must be at least 18 years old to create an account. Notify us immediately if you suspect unauthorized access.
4. Organization Accounts
Organizations may invite team members to collaborate within the platform. Organization administrators are responsible for managing team member access and ensuring that all members comply with these terms. Administrators may remove team members or modify their access at any time.
5. Acceptable Use
You agree not to use Donation Retriever for any unlawful purpose, to misrepresent your identity or organizational affiliation, to interfere with or disrupt the service or other users' access, to attempt unauthorized access to any part of the service, or to upload malicious code or content. We reserve the right to suspend accounts that violate these terms.
6. Donor Data
Organizations using Donation Retriever may collect personal information from donors, including names, email addresses, phone numbers, and mailing addresses. Organizations are responsible for obtaining appropriate consent from donors before entering their information into the system. Donation Retriever processes donor data on behalf of the organization and does not independently contact donors except as required to operate the service (such as sending donor-facing permalink pages).
7. Intellectual Property
The Donation Retriever service, including its design, code, features, and documentation, is owned by Unicorn Powered Company. You may not copy, modify, distribute, or reverse engineer any part of the service. Your use of the service does not grant you ownership of any intellectual property.
8. Data Ownership and Portability
You retain full ownership of the data you enter into Donation Retriever, including donation records, donor information, and organizational data. You may request an export of your data at any time by contacting us at support@donationretriever.com. We will provide your data in a standard, machine-readable format within 30 days of your request.
9. Service Availability
Donation Retriever is provided on an “as is” and “as available” basis. We strive for high availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.
10. Limitation of Liability
To the maximum extent permitted by law, Unicorn Powered Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total aggregate liability for any claims related to the service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100).
11. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access if you violate these terms or if we discontinue the service. Upon termination, you will have 30 days to request an export of your data. After that period, we may delete your data in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms of Service from time to time. We will notify registered users of material changes via email or through the service. Your continued use of Donation Retriever after changes take effect constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
13. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved in the courts located in Texas.
